Through this order I intend to dispose of an application moved by the complainant for summoning a witness namely Muhammad Amin, ASI as PW who conducted initial inquiry in the instant case. Although name of said witness is not mentioned in the calendar of witnesses, however record shows that his evidence in the instant is essential. Counsel for respondents /accused showed his objection over acceptance of application of the complainant / petitioner. As per section 540 Cr. PC, the Court at any stage of any inquiry, trial or other proceeding summon any person as a witness, or examine any person in attendance, if his evidence appears to it essential to the just decision of the case. As such proposed witness is acquainted with facts relating to the case in hand, whose testimony is material for this Court to reach at proper conclusion, therefore, the application stands accepted.
